Mr.Sanjay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 01-03-2019 As prayed, learned counsel for the petitioner is permitted to add S. T. No.28/2019 in paragraph no.1 and prayer portion of the petition.

Heard learned counsel for the parties.

Petitioner seeks bail in S.Tr. No.28/2019 arising out of Bikramganj P.S. Case No. 400/18 registered for the offence punishable under Sections 366(A), 120(B)/34 of the Indian Penal Code.

Informant is the brother of the victim who has alleged in his written complaint that on 18.09.2018 at about 9 a.m., his sister Sapana Kumari @ Veena Kumari aged about 17 years along with her friend Rani Kumari had gone and, thereafter, did not return.

No.6112 of 2019(3) dt.01-03-2019 2/3 The victim girl was recovered and in her statement under Section 164 Cr.P.C., she had stated that she went with one Vikash Kumar and there is no allegation of any sexual assault against her committed by said Vikash Kumar. Allegation against the petitioner is that she provided some assistance to Vikash Kumar in taking away the victim Sapana Kumari. The petitioner is a lady having no criminal antecedent and she is in custody since 07.10.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J. -12, Rohtas, Sasaram in connection with S.Tr. No.28/2019 arising out of Bikramganj P.S. Case No. 400/18, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the
