Petitioner is accused in connection with Khudwan P.S. Case No. 01 of 2016 registered under Sections 341, 307, 504/34 of the I.P.C. and 27 of the Arms Act.
The accusation is that while the informant along with his brother Rangesh Kumar was sitting in the field, at that time Renu Devi, wife of the petitioner came covering a single barrel gun in the blanket and handed over to this petitioner. Thereafter, this petitioner shot fire at the informant and his brother, both succeeded to flee away and reached at the Police Station and informed about the incident.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.19415 of 2016 (2) dt.05-05-2016 2/2 submits that it would appear from the F.I.R. itself that there is land dispute in between the petitioner and informant. Due to that reason, the present case has been lodged with false allegation, whereas wife of the petitioner has also lodged Khudwan P.S. Case No. 03 of 2016 against the informant, his brother and father and others. Moreover, while the allegation is about firing by the petitioner but none has been injured. It is also submitted that petitioner is in custody since 19.01.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Daudnagar, Aurangabad in connection with Khudwan P.S. Case No. 01 of 2016.
