JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks bail in connection with Harnaut (Telmar) P.S. Case No. 71 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is said to have fired at the deceased, causing injury to him, who later on succumbed to the injuries. Submission of learned counsel for the petitioner is that the informant does not appear to be an eye-witness to the occurrence and petitioner is in custody for more than six months.

Heard learned APP, who has opposed the prayer for bail of the petitioner.

In view of direct allegation against the petitioner, I am not inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.3510 of 2020(2) dt.28-01-2020 2/2 Accordingly, this application is dismissed.

However, learned court below is directed to expedite the process of commitment of the case.
