JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 This application, for grant of anticipatory bail, arises out of Kargahar P.S. Case No. 100 of 2018, disclosing offences under Sections 147, 148, 149, 302, 307, 323, 354, 504 and 452 of the Indian Penal Code.
Allegation as per F.I.R is that co-accused persons surrounded one Bimlesh Singh and fired at him and when the family members of said Bimlesh Singh was taking him to hospital, then, the petitioner and others came there and also made firing causing fire arm injuries to some persons and it is alleged that petitioner fired at one Ramashish Singh. Submission of learned counsel for the petitioner is that he is aged about 70 years and has falsely been roped in the present case and the said Ramashish has received injury by firing made by some other person. Further submission is that
Patna High Court Cr.Misc. No.2200 of 2019(2) dt.16-01-2019 2/2 no allegation of firing on the deceased has been attributed to the petitioner.

Having heard both sides, considering the submission, as above and also the fact that the petitioner is aged about 70 years, as such, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III, Rohtas at Sasaram, in connection with Kargahar P.S. Case No. 100 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
