JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 This is an application for grant of anticipatory bail in connection with Jamui P.S. Case No. 302 of 2018, disclosing offences under Sections 302, 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other co-accused persons dragged the deceased towards his house and later on the dead-body of the deceased was found. Submission of learned counsel for the petitioner is that the deceased was a veteran criminal and the petitioner has falsely been implicated in this case. Further, there is no eye witness of the occurrence.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances as stated above, I am not inclined to grant

Patna High Court Cr.Misc. No.6654 of 2019(2) dt.05-02-2019 2/2 anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
