2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 323, 386, 406, 420, 467, 468, 471 and 120B of the Indian Penal Code.
3. As per prosecution case, altercation took place between informant, who is owner of a house and care taker of the house. It is further alleged that all the accused persons demanded ransom of Rs. 6,00,000/- from informant.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has been made an accused in this case merely because he was living on rent in the house of
Patna High Court CR. MISC. No.6016 of 2025(2) dt.27-02-2025 2/2 informant. From bare perusal of the F.I.R. it is apparent that entire accusation is against co-accused Vijay Pathak, who is alleged to be caretaker of the house in question. There is no specific accusation of overt act against this petitioner.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st, Buxar in connection with Dumraon P.S. Case No. 196 of 2009, subject to condition as laid down under Section 482 of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
