Petitioner apprehends arrest in connection with Khutauna P.S. Case No. 128 of 2021 registered for the offence punishable under sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from a place near the furniture shop of this petitioner which is an open place and is accessible to all. Petitioner has no concern with the seized article. Petitioner has no criminal antecedent.

Case No. 128 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
