The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The petitioner is not named in the FIR. The name of petitioner figured in the case on the confessional statement of Surendra Singh @ Nengra who has already been enlarged on bail vide order passed in Cr. Misc. No. 41436/2013. The petitioner's call detail was obtained and it transpired that the petitioner was also present in the village Hario. Except the fact that on the basis of call detail the location of the petitioner was found in the same village, there is no material to show the involvement of the petitioner.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.29002 of 2015 (2) dt.10-08-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in Bihpur P.S. Case No. 41/2013.
