JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One mobile set and two sims which are said to have been used in the alleged crime, have been recovered from possession of the petitioner which is evident from perusal of para63 of the case diary but admittedly, petitioner does not have any criminal antecedent nor any extortion money was paid. Moreover, at para-69 of the case diary, petitioner disclosed that he had already destroyed one sim which had been used in committing the crime.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is in jail custody since 24.03.2015, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.30509 of 2015 (3) dt.29-10-2015 2/2 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Naokothi P.S. Case No. 18 of 2015.
