Petitioner seeks bail in a case registered under sections 395 and 397 of the Indian Penal Code.

One Chandan Kumar Singh was apprehended by the police on the basis of tower location of the mobile and subsequently, his confessional statement was recorded. The aforesaid Chandan Kumar Singh disclosed the name of the petitioner and others and thereafter, petitioner was arrested from the platform of Muzaffarpur railway station.

Admittedly, nothing was recovered from the conscious possession of the petitioner nor he has been put on T.I. Parade. Petitioner in jail custody since 10.1.2016 and except one case, i.e. Muzaffarpur Rail P.S. case no. 80/2014, there is no other criminal antecedent against the petitioner.

Patna High Court Cr.Misc. No.20076 of 2016 (2) dt.06-05-2016 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Bettiah, West Champaran in Sugauli Rail P.S.
