In this case, the petitioner is seeking bail in connection with Matiayaria P.S. Case No. 56 of 2015 registered for offence under section 366-A/34 of the Indian Penal Code. On the day of the incident, the victim had gone along with her friend. When she had not returned then her father started searching her and was informed that the present petitioner had taken away the victim. In the statement under section 164 Cr.PC., the victim has stated that she was forcibly taken away on the motor cycle by the petitioner. When she asked as to where he is taking her then she was informed that they will go to her material uncle, she was taken to Bagaha where she was sitting in a chair

Patna High Court Cr.Misc. No.21121 of 2016 (2) dt.19-05-2016 2/2 outside the house, by that time, her father came there and returned along with the victim.

Allegation has been made, the victim was sexually assaulted three times.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sr. S.D. Bharti, Judicial Magistrate 1st class, Bettiah, West Champaran in connection with Matiayaria P.S. Case No. 56 of 2015. (Shivaji Pandey, J) Mahesh/- U T
