2. The petitioner has preferred this application for grant of regular bail in connection with Tisiauta P.S. Case No. 59 of 2024 dated 06.06.2024 registered for the offences punishable u/ss 341, 323, 324, 325, 307, 354, 379, 504, 506 read with section 34 of the Indian Penal Code and later on added 302 has been added.
3. As per the prosecution case, on 5-6-2024 at 8 pm, Matuk Rai was laying the foundation of pillar on the informant's land, on protest, Matuk Rai started abusing the informant and ordered Vipin Rai and Lakhindra Rai to kill the informant, on which Lakhindra Rai assaulted him with farsa causing injury on

No.7570 of 2025(2) dt.03-04-2025 2/3 his head, and when his family members came to save him, the accused Jagarnath along with other named accused persons and ten unknown accused came variously armed and assaulted Mithilesh, Anil and Sanjaniya Devi causing injury on head and Matuk also assaulted Sanjaniya by lathi causing fracture of her hand and also snatched her golden chain.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to land dispute. The petitioner is a lady and having a child in her lap. There is general and omnibus allegation against the petitioner. Similarly situated co-accused has already been granted bail by the co-ordinate bench of this court vide order dated 23.10.2024 passed in Cr. Misc. No. 66016 of 2024. As per the supplementary affidavit, the petitioner has one criminal antecedent. The petitioner is in custody since 21.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.7570 of 2025(2) dt.03-04-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Tisiauta P.S. Case No. 59 of 2024.
7. The application stands allowed.
