JUSTICE GOPAL PRASAD ORAL ORDER 14-01-2015 Heard learned counsel for the petitioners and learned counsel for the State.

Two bail petitions are being heard together and disposed of by common order as two cases arise in connection with Khodawandpur P.S. Case No. 31 of 2014 registered under Sections 395, 397 and 120(B) of the Indian Penal Code. Learned counsel for the petitioners submits that there is neither any recovery from the possessions of the petitioners nor petitioners have put on T.I. Parade. Only allegation against these petitioners is that their names have find place on confessional

Patna High Court Cr.Misc. No.29744 of 2014 (5) dt.14-01-2015 statement of co-accused. However, petitioner in Cr. Misc. No. 32838 of 2014 has criminal antecedent and except this case two case are pending against him for offence under Sections 307 and 323 of Indian Penal and 25(1-b), 26 and 35 of the Arms Act. Having regard to the facts and circumstances of the case, the above named petitioners are directed to the released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar, 1st Class, Judicial Magistrate, Begusarai, in connection with Khodawandpur (Chhaurahi) P.S. Case No. 31 of 2014, subject to the condition that petitioner will appear on each and every date fixed in this case by the court below and any absence of the petitioner shall be subject to satisfaction of the court below on reasonable ground. Further condition that petitioner shall not remain absent on two consecutive dates failing which his bail bond shall stand cancel by the court below.
