JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Shankarpur P.S.Case No. 64/2015, disclosing offences under sections 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioners, has submitted that there is no specific allegation of assault against the petitioners, though there is such allegation against co-accused Manoj Pandit. It has further been submitted that co-accused Hardeo Pandit, against whom there is allegation of instigating Manoj Pandit, has been granted regular bail by this Court vide order dated 10.11.2015 passed in Cr.Misc.No. 50206/2015.

Patna High Court Cr.Misc. No.22958 of 2016 (2) dt.24-05-2016 Considering the above submissions, this application is allowed.

Let the petitioners, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Madhepura in Shankarpur P.S.Case No. 64/2015.

This is subject to the condition that the petitioners shall present themselves before the police/ court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
