The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner assaulted the informant with Tengari.
It is submitted that both parties are own brothers and present FIR has been lodged only with a view to save skin from the case lodged by the petitioner in which cognizance has been taken under Section 379, 324 and other allied sections of the Indian Penal Code. The alleged occurrence took place due to dispute with regard to residential house and petitioner is younger brother of informant. Injury caused to the informant is
Patna High Court CR. MISC. No.6646 of 2022(4) dt.21-11-2022 2/2 simple in nature. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 97 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
