After retirement from service the petitioner raised his grievance that he has been denied the benefits of ACP and MACP. Petitioner was appointed as the post of Laboratory Boy and on the said post he retired on 31.0.2018 but the case of the

Patna High Court CWJC No.3074 of 2020(2) dt.24-02-2020 2/2 petitioner has not be considered for any promotion during his service period.

In view of the aforesaid, the writ petition is disposed of with a liberty to the petitioner to represent the respondents enclosing all the documents to demonstrate that he was appointed on the post of Laboratory Boy against sanctioned vacant and having requisite qualification. If such a representation is filed by the petitioner, the authority of the University shall take appropriate decision in accordance with law at the earliest preferably within a period of three months from the date of receipt/production of a copy of this order for grant of benefit of ACP and consequential monetary benefits.
