The petitioner apprehends his arrest in connection with Suppi PS Case No. 114 of 2021 dated 20.06.2021 registered under Section 363, 366 of the IPC. As per the FIR petitioner along with other accused persons kidnapped the minor daughter of the informant. Learned counsel for the petitioner submits that there was love affair between the co-accused and the daughter of the informant. The daughter of the informant as stated in the FIR is said to be 17 years old and was mature enough to take her own decision. This is a case of adolescent love affair between the co-accused / Manish Kumar and daughter of the informant and the informant's daughter and the co-accused / Manish Kumar

Patna High Court CR. MISC. No.9039 of 2023(2) dt.19-05-2023 2/2 have solemnized marriage which has been stated in para- 10 of this bail application. Learned counsel next submits that in her statement recorded under Section 164 Cr.P.C. the victim girl has not supported the prosecution story.

Regard being had to the submission made by the parties, taking into consideration the fact that petitioner is the co-villager of the informant and the daughter of the informant has performed marriage with the co-accused Manish Kumar, I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge- VI-cum- Special Judge (POCSO Act), Sitamarhi in connection with Suppi PS Case No. 114 of 2021 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
