JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2016 Heard learned counsels for the petitioner and learned APP for the State.

The petitioner is languishing in custody since 09.12.2015 in a case registered for the offences punishable under sections 20 and 22 of the NDPS Act, in connection with Special Case No.13/2015 arising out of Maheshkhunt P.S. Case No.138/2015, pending before the 1st Additional Sessions Judgecum-Special Judge, Khagaria. From the house of the petitioner 20 Kg. of 'ganja' wrapped in four packets were recovered.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house and the petitioner has no criminal antecedent.

Considering the commercial quantity of recovery of

Patna High Court Cr.Misc. No.20081 of 2016 (2) dt.05-05-2016 2/2 'ganza', this court is not inclined to grant bail to the petitioner at present. Accordingly, the prayer for bail on behalf of the petitioner is rejected.

Let the trial be expedited.
