Despite repeated calls, none appears on behalf of the State.
The petitioner seeks bail in connection with Rajiv Nagar P.S. Case No.47 of 2014 registered under section 379 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 25.9.2014 passed in Cr. Misc. No.3418 of 2014 with observation that if the trial is not concluded within six months from the date of receipt/production of a copy of this order, the petitioner would be entitled to renew his prayer for bail.
It has been contended that till date not even a single witness has been examined during trial and the petitioner is in
Patna High Court Cr.Misc. No.28133 of 2015 (2) dt.09-07-2015 2/2 custody since 8.5.2014.
Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, Judicial Magistrate, 1st Class, Patna in connection with Rajiv Nagar P.S. Case No.47 of 2014.
