The petitioner is languishing in custody for the offence punishable under Section 353/307 of the Indian Penal Code and Section 25(1-B)A, 26, 27 of the Arms Act in connection with Sessions Trial No. 197 of 2018 arising out of Bihata P.S. Case No. 566 of 2017.

On disclosure of this petitioner pistol and cartridges were recovered from the house of the petitioner. Petitioner further disclosed that the same pistol was used for murder of Anjani Kumar Pandey @ Mithu. Petitioner is accused in six cases most of them are of murder and under Arms Act. Petitioner is in custody since 18.08.2017.

Considering the nature of allegation and criminal

Patna High Court CR. MISC. No.5594 of 2019(3) dt.22-04-2019 2/2 antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, his prayer for bail is refused. Learned trial court is directed to expedite the trial. (Birendra Kumar, J) Banti/Rajan U T
