2. The petitioner seeks bail in connection with Magadh University P.S. Case No. 85 of 2025 dated 12.04.2025, instituted for the offence punishable under Sections 126(2), 352, 115(2), 109(1), 103, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that on the alleged date of occurrence, an altercation took place between the informant and accused persons including the petitioner. It is alleged that the accused persons assaulted the informant and his family members by means of lathi-danda and sharp weapon. It is alleged that they assaulted on the stomach of the informant's son by sharp weapon due to which he received serious injury and died during the course of treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the F.I.R. has been lodged against 11 named accused persons including the petitioner. There is no specific allegation against the petitioner rather the allegation against all the accused persons are general and omnibus. It is further submitted that co-accused Chhotu Kumar has been granted bail today itself by a co-ordinate Bench of this Court in Criminal Miscellaneous No. 4960 of 2026. Lastly, it has been submitted that the petitioner is in custody since 12.08.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IV, Gaya Jee in Magadh University P.S.
