ANJANA MISHRA ORAL ORDER 01-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 07.12.2013 in connection with a case registered for the offences punishable under Sections 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the First Information Report but subsequently, on the confessional statement made before the Police by a coaccused which has got no evidentiary value, the petitioner has been taken into custody. It is further submitted that despite lapse of almost 2 1⁄2 years neither the petitioner has been put on Test Identification Parade nor any recovery has been made from his possession.

Considering the aforementioned facts and circumstances, let

Patna High Court Cr.Misc. No.23365 of 2016 (2) dt.01-06-2016 P2/2 the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.
