The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per allegations in the F.I.R, on information having been received about the accused persons planning to give effect to an occurrence, a raid was conducted and five accused persons including the petitioner were caught. It is stated that three live cartridges were recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case and no incriminating article has been recovered from his possession. He

Patna High Court CR. MISC. No.15751 of 2021(2) dt.05-08-2021 2/2 is in custody since 15.8.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Sirdala P.S. Case no. 312 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Nawada.
