JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 29.10.2015 passed in Cr. Misc. No. 30610 of 2015 on the ground that the petitioner is in custody since 20.01.2015, the recovered amount and the articles are of the petitioner, there is nothing to show that the cash amount recovered was part of the looted amount as there was no identification mark and the confessional statement of the petitioner has got no evidentiary value in the eye of law, to which the learned A.P.P. opposes by submitting that on the basis of the confessional statement of the petitioner cash of Rs. 1,20,000/- was recovered besides two gold chain, one gold ring and one gold covered rudraksh

In the facts and circumstances as stated above, at present finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 98 of 2016 arising out of Fatuha P.S. Case No. 153 of 2014 pending in the court of 7th Additional Sessions Judge, Patna City.

However, let the trial be expedited and concluded preferably within a period of six months from the date of receipt/production of a copy of this order.
