1. Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner is named in the F.I.R. and apprehending his arrest in connection with Ara Muffasil P.S. Case No. 207 of 2023 registered for the offences punishable under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The allegation against the petitioner is to involve in celebratory firing alongwith other co-accused persons in the marriage ceremony, where two persons alleged to received gunshot injury.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has committed no offence. It is submitted that allegation of firing is

Patna High Court CR. MISC. No.10767 of 2024(2) dt.22-02-2024 2/2 available against co-accused Rajiv Singh @ Ranajan, who has already granted regular bail from the learned Co-ordinate Bench of this Court through Cr. Misc. No. 75106 of 2023 vide order dated 29.11.2023.

5. Learned APP appearing on behalf of the State, opposes the prayer for bail.

In view of the facts and circumstances as mentioned above and by taking note of the fact, as allegation of celebratory firing is not available against this petitioner, accordingly the petitioner above named, in the event of hia arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Bhojpur at Ara/concerned Court below where the case is pending in connection with Ara Muffasil P.S. Case No. 207 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
