The petitioners seek their bail in a case registered under Sections 366A, 376, 506/34 of the IPC and section 6 of POSCO Act.
The informant alleged that Saheb Sahni and Amar Sahni kidnapped his minor daughter. The victim was recovered. She made her statement under section 164 Cr.P.C and stated categorically that Saheb Sani and Amar Sahni kidnapped her and confined her in a house. She further disclosed that Amar Sahni and Saheb Sahni committed rape on her.
There is specific allegation against petitioner no.1 Amar Sahni that he also committed rape with the victim, who is minor. Considering the facts aforesaid, I am not inclined to enlarge petitioner no.1 Amar Sahni on bail and accordingly, the same is rejected So far as the case of petitioner no.2 Bachchan Sahni is concerned, the informant has made allegation that he used to bring
Patna High Court Cr.Misc. No.2977 of 2015 (4) dt.25-06-2015 2/2 food for her while she was kept confined in his house but there is no allegation of committing rape against him. Considering the facts aforesaid, petitioner no.2 Bachchan Sahni @ Ram Bachchan Sahni is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge-cum-Special Judge, West Champaran at Bettiah in connection with Majhaulia P.S.
