====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 01-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nauhatta Darhar O.P. P.S. Case No. 160 of 2018, instituted for the offence under Section(s) 363 and 366A/34 of the Indian Penal Code. Counsel for the petitioner submits that petitioner is a lady. In the written report there is no allegation of any specific overt act against the petitioner.

The victim girl on recovery has given statement under Section 164 Cr. P.C. wherein she has stated that she had voluntarily gone with Awesh Kumar and has performed marriage with him.

Petitioner is in custody since 5.11.2018 having clean antecedent.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Judicial Magistrate, Saharsa, in connection with Nauhatta Darhar O.P.
