JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim has renewed his prayer for anticipatory bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
The accusation is of killing the sister of the informant after seven years of marriage for non fulfillment of dowry demands.
On conclusion of investigation, final form (charge sheet) was submitted under section 306 IPC. Since earlier anticipatory bail application of the petitioner was dismissed by a co-ordinate bench of this court vide Cr. Misc. No. 15449 of 2006, this court is

No.20567 of 2016 (2) dt.13-05-2016 2/2 not inclined to interfere in the matter but keeping in view the fact that the victim died after seven years of marriage and charge sheet was submitted under section 306 IPC, more over it is submitted that co accused (father of the petitioner) has been put on trial and acquitted, it is a case for consideration of regular of the petitioner in case the petitioner surrenders within six weeks from today in connection with Sadar Mufassil P.S. Case No. 210 of 2005 pending in the court of learned C.J.M. Siwan. This application is disposed of with the aforesaid observation/direction.
