1. Heard learned counsel for the petitioners and learned A.P.P. for the State along with learned counsel for the informant.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 143, 341, 323, 324, 354, 354(B), 307, 447, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner no. 1 is a person with clean antecedent and petitioner no. 2 has antecedent of two cases but inadvertently at Para-3 it has been recorded that petitioner no. 2 has antecedent of one case. It is further submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that specific allegation of

Patna High Court CR. MISC. No.7324 of 2024(2) dt.01-03-2024 2/2 assault is against Munna Thakur and against these petitioners the allegation of assault is general and omnibus in nature. It is also submitted that even the injured suffered simple injury.

Learned A.P.P. for the State along with learned counsel for the informant opposes the prayer for anticipatory bail of the petitioners, but are not in a position to rebut the submission of the learned counsel for the petitioners that the allegation of assault against them is general and omnibus in nature.

5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dumariyaghat P.S. Case No. 269 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishabh/- U T
