JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case registered under Sections 461, 379 of the Indian Penal Code.

Submission of learned counsel for petitioner is that the petitioner is not named in the FIR. In course of investigation the petitioner was apprehended by the police mere on suspicion and on search a country made pistol was recovered from the house of the petitioner. Except that there is nothing against the petitioner. It is further submitted that regarding recovery of country made pistol, Lodipur P.S.Case No. 116 of 2015 has been lodged. In the present case the petitioner is in custody since 22.1.2016. Having considered the facts and circumstances of the

No.20777 of 2016 (2) dt.19-05-2016 2/2 case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali (Adampur) P.S.Case No. 766/ 15. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
