The petitioner, who is in custody since 28.08.2019 seeks bail in connection with Saharsa Sadar P.S. Case No. 400 of 2019 dated 03.05.2019 instituted for offence under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
On secret information that some miscreants have assembled at a place to commit an offence, a raid was conducted. One person was arrested, whereas two others managed to flee away. Arrested person disclosed his name as Ajay Kumar Das, from whose possession fire arm weapons
Patna High Court CR. MISC. No.4647 of 2020(3) dt.05-06-2020 2/2 were recovered. Aforesaid Ajay Kumar Das is said to have named the petitioner also as one of his associates. It has been urged on behalf of the petitioner that four other cases, in which he has been made accused, he was not named in the F.I.R. but only later he was made accused in such cases.
Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saharsa in connection with Saharsa Sadar P.S. Case No. 400 of 2019.
