The petitioners are in custody since 28.11.2015 in connection with Jadopur P.S. Case No. 78 of 2015 registered under Sections 302, 201/34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel appearing for the petitioners submits that the entire case against the present petitioners is based on mere

Patna High Court Cr.Misc. No.20071 of 2016 (3) dt.31-05-2016 suspicion as petitioner, Ramu Singh is the brother-in-law of the deceased. It is submitted that Rinku Devi, wife of another brother Sunil Singh had been creating internal strife in the family for the reason that the husband of the victim lady was not earning enough and it was on account of this reason that the petitioner Ramu Singh connived with the petitioner, Upendra Singh, who is the brother of said Rinku Devi, to give shape to the present occurrence.

Case diary, in the present case, has been called for, which has since been received.

Learned counsel appearing on behalf of the State, after referring several paragraphs of the case diary, submits that save and except suspicion, there is no other material in the case diary to support the allegation against the present petitioners. 6.

Taking into consideration aforementioned fact and also the period of custody, petitioner, Ramu Singh and petitioner, Upendra Singh, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gopalganj in connection with Jadopur P.S. Case No. 78 of 2015.
