15-11-2017 The present petition has been filed for restoration of restoration petition i.e. M.J.C. No. 1152 of 2016. The said restoration petition i.e. M.J.C. No. 1152 of 2016 stood dismissed due to non-appearance of learned counsel for the petitioner on two consecutive dates. The writ petition i.e. C.W.J.C. No. 11594 of 2011 was not dismissed on merit, rather it was dismissed due to non-prosecution.

Sri Sanjay Kumar Tiwari, learned counsel for the petitioner, in presence of learned A.C. to Addl. Advocate

Patna High Court MJC No.2728 of 2017(3) dt.15-11-2017 2/2 General - 15, tried to persuade the Court that the reason for his non-appearance in earlier restoration petition was beyond his control.

However, after examining the same, the Court is not persuaded with the ground for restoration of the petition. Accordingly, the present restoration petition, which has been filed for restoration of restoration petition i.e. M.J.C. No. 1152 of 2016, stands dismissed.
