JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE) 07-02-2023 The petitioner is a resident of Ward No. 1, Karbaddha Pataili, under the Police Station Ujiyarpur, DistrictSamastipur. He has filed this writ application, in the nature of public interest litigation, aggrieved by the decision of the State Government to include the area of Ujiyarpur Circle with the office of Sub-Registrar Dalsinghsarai, constituted in exercise of power under Section 5(1) of Registration Act, 1908. It is the main grievance of the petitioner that Dalsinghsarai is nearly 25 Kms away from Ujiyarpur. According to him, had Ujiyarpur Circle been allowed to remain under Samastipur Sub-Registrar

Patna High Court CWJC No.1752 of 2023(2) dt.07-02-2023 2/2 Office, it would have been convenient for the inhabitants of Ujiyarpur Circle.

In our considered opinion, convenience or inconvenience of the nature, as being mentioned by the petitioner, cannot be the basis for the Court to interfere in the matter of establishment of the offices of Sub-Registrar in a Public Interest Litigation proceeding. No interference is warranted in the matter.

This application is accordingly dismissed.
