1. Heard the parties.

2. The present writ application has been filed for a direction to conduct inquiry regarding financial irregularities and distribution of grant-in-aid among the fake employees of Chandradeo Prasad Verma College, Simri, Bihta and a direction to the respondents to allow the petitioners to put signature on the attendance register and discharge duties and directing the respondents to issue payment out of relief in grant released by the State Government for the session 2011-16.

3. Learned counsel for the petitioners submits that some of the writ petitioners i.e., petitioner nos. 1, 4, 5, 7, 8, 9, 10, 11 had approached this court for payment of grant-in-aid and to direct inquiry for financial irregularities, however, the learned

3/4 counsel was not informed regarding the writ application having filed by them before this Court in CWJC No. 8768 of 2023.

4. Learned further submits that he wants to withdraw the writ application for the aforesaid petitioners who had approached this court earlier and seeks permission to pursue the case for the remaining petitioners i.e. petitioner nos. 2, 3, 6, 12.

5. Permission is granted.

6. Accordingly, the present writ application is dismissed as withdrawn for the aforesaid petitioners who had approached this court earlier.

7. The present writ application survives for the remaining petitioners i.e., petitioner nos. 2, 3, 6, 12.

Mr. Navin Prasad Singh, learned counsel appearing for the respondent no. 11 and University and State jointly submit that in the writ application filed by some of the petitioners along with other similarly situated persons bearing CWJC No. 8768 of 2023, a Co-ordinate Bench has disposed the writ application allowing the petitioners to raise the grievance before the District Appellate Authority and pursue the same.

9. Having regard to the fact that the Appellate Authority has been authorized under the Bihar State Teaching Institutions Teachers and Employees Rules, 2020, to decide

4/4 such kind of disputes, accordingly, this writ application is disposed with liberty to the remaining petitioners i.e., petitioner nos. 2, 3, 6, 12 to approach the District Appellate Authority within one month for redressal of their grievance.

10. Accordingly, the present writ application is disposed with the aforesaid liberty.
