The petitioner is languishing in custody since 14.02.2016 in connection with Gopalpur P.S. Case No. 99 of 2012 (G.R. No. 444/2012) for the offences instituted under Sections 376 and 302/201 of the IPC.

The accusation is of killing the daughter of the informant after committing rape by some unknown persons. The informant identified the dead body of his daughter lying in a Maize crop field.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 14.02.2016 and the charge sheet has been submitted

Patna High Court Cr.Misc. No.20007 of 2016 (3) dt.19-07-2016 2/2 in the present case. There is no allegation of tampering with the evidence. The petitioner is not named in the F.I.R. Subsequently, the informant, in course of investigation, has named this petitioner raising suspicion against him. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the implication of this petitioner in the present case. The other co-accused persons have been granted regular bail and anticipatory bail vide Cr. Misc. Nos. 10831/2016 and 13550 of 2016 respectively.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Naugachia, Bhagalpur, in connection with Gopalpur P.S. Case No. 99/2012( G.R. No. 444/2012).
