The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Sikraul P.S. Case no. 102 of 2020 instituted for the offence punishable under Section 365 of the Indian Penal Code. As per allegation in the FIR, petitioner had kidnapped the daughter of the informant while she had gone to her college. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There was love affair between the petitioner and daughter of the informant. FIR version does not tally with the statement of the victim given before the police u/s 161 of the
Patna High Court CR. MISC. No.16241 of 2021(7) dt.31-03-2022 2/2 Cr.P.C. and also not tally with the statement u/s 164 Cr.P.C. given before the Judicial Magistrate, which was given under pressure of her parents. Victim is major in age and is a married lady. Out of her own sweet will, she has eloped with the petitioner due to love affair.
Learned APP appearing for the State has opposed the prayer of bail and submitted that victim girl has specifically stated that petitioner had taken away her by scorpio at Patna. This is not a fit case for granting anticipatory bail. Having heard learned counsel for the parties and taking into consideration that there is specific allegation of kidnapping against the petitioner, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
