Patna High Court CWJC No.1397 of 2019 dt.25-01-2019 2/3 Assistant Professor in the Department of Medicine from Sri Krishna Medical College and Hospital, Muzaffarpur in the year 2002.

2. It has been submitted by the learned counsel for the petitioner that during the entire period of his service career, he was not visited with any departmental or judicial proceeding and has spent thirty one years serving the Government. The petitioner claims that he has not been paid 1st and 2nd A.C.Ps. and similarly the fixation of post retiral dues and benefits also do not include the benefits which ought to have accrued to him by way of 1st and 2nd A.C.Ps. It has further been submitted that a representation has also been filed by the petitioner before the Additional Secretary, Health Department, Govt. of Bihar, Patna (respondent No. 3), but the same has not been acted upon till date.

3. Let a fresh representation be filed by the petitioner with all necessary facts before the Principal Secretary, Health Department, Govt. of Bihar, Patna (respondent No. 2), within a period of four weeks from

Patna High Court CWJC No.1397 of 2019 dt.25-01-2019 3/3 today, along with the copy of this order.

4. On receipt of such representation/application, the Principal Secretary, Health Department, Govt. of Bihar, Patna (respondent No. 2) shall look into the matter and dispose off the same. In case, the claim of the petitioner is maintainable, necessary sequel orders shall be passed, without any delay, within a period of six weeks thereafter.

5. With the aforesaid observation and direction, the writ petition stands disposed off.
