The petitioner is languishing in jail custody since 27.03.2015 in a case registered for offences punishable under Sections 304 (B), 201/34 of the Indian Penal Code. The prosecution case is that informant Badari Mukhiya is the Uncle of the deceased Seema Devi. It is alleged that deceased was married with Mahesh Mukhiya about one year ago and when she went to her Sasural after Gauna then her in-laws family members started demanding Godrej almirah and motor cycle and for which she was being assaulted and tortured. The deceased had informed the above facts when she came to her Mayaka. It is further alleged that on 03.05. 2014 the informant was informed on phone that his niece has been killed and her body has been disposed of. On this information the informant along with some

Patna High Court Cr.Misc. No.29207 of 2015 (2) dt.05-08-2015 2/2 other persons went to Khutauna where they were informed by the villagers that the accused persons have killed his niece and thereafter with an intention to destroy the evidence her dead body has been disposed of. On the basis of written report Khutauna P.S. Case No. 27/2014 was registered under Section 304 (B), 201/34 I.P.C. against the accused persons.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and she is mother-in-law of the deceased Seema Devi and she was not living with the family of her son the petitioner after partition.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Jhanjharpur, District- Madhubani in connection with Khutauna P.S.Case No. 27/2014 (Nilu Agrawal, J) Sudha/- U T
