2. The petitioner who hails from the Cobbler caste which is the predominant caste of the locality, is aggrieved by the fact that respondent no. 9 who belongs to another Extremely Backward Class but minority in number has been appointed as Vikash Mitra in derogation of the guidelines issued by the Government of Bihar for the purposes of appointment of Vikash Mitras.

3. Learned counsel appearing for the petitioner has submitted that the list of BPL families of the

Patna High Court CWJC No.1171 of 2019 dt.21-01-2019 2/2 Panchayat under reference clearly indicates that persons belonging to Cobbler Caste are in majority.

4. Such representation by the petitioner has also been filed before the District Magistrate, Madhubani which is still pending consideration.

5. The District Magistrate, Madhubani is directed to dispose of the representation filed by the petitioner within a period of six weeks from today.

6. In case of necessity, a hearing may be given to the petitioner and in case any order is to be passed which would be against the interest of respondent no. 9, he too shall be heard.

7. With the aforesaid observation/direction, the writ petition is disposed of.
