Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2022 Heard Mr. Dhananjay Kumar Tiwary, learned Advocate for the petitioner and the learned APP for the State.
The petitioner seeks bail in anticipation of his arrest in connection with Digha P.S. Case No. 245 of 2020 dated 01.05.2020 instituted for the offences under Sections 188, 268, 269, 270, 341, 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is alleged to have broken the fence over a plot of land which is in the process of being purchased by the informant.
Patna High Court CR. MISC. No.15775 of 2021(2) dt.28-02-2022 2/3 Learned counsel for the petitioner has submitted that the accusation is absolutely false. The petitioner has purchased the aforesaid plot of land from one Shankar Kumar who had the right and title to sell the aforesaid plot of land to him.
Learned counsel for the petitioner has further submitted that he has filed a complaint case against the informant of the subject FIR and others. No offence appears to have been made out under anyone of the Sections of IPC in which the petitioner is sought to be prosecuted.
Learned counsel for the petitioner has submitted that in order to give a serious color to a civil dispute between the parties, the aforesaid FIR has been registered.
Considering the afore-noted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production

No.15775 of 2021(2) dt.28-02-2022 3/3 of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 245 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
