The petitioner seeks bail in a case under Section 395 and other sections of the Indian Penal Code.

The petitioner is not named in the F.I.R. The case was lodged against six unknown persons for looting a truck, bearing registration no. HP-12D-2758, laden with Horlicks. Nothing has been recovered from the possession of the petitioner. The petitioner is in jail since 18.04.2015 but he has not been put on T.I.P. Sunil Pandey, a similarly situated accused person, has already been granted bail vide order passed in Cr. Misc. No. 29219 of 2015.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.30377 of 2015 (2) dt.13-08-2015 2/2 amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sherghatti, Gaya in Amas P.S. Case No. 175 of 2014.
