In this case, the petitioner apprehends his arrest in connection Kursakanta P.S. Case No. 190 of 2019 registered for offence punishable under sections 147, 341, 323, 498(A), 307 and 506 of the Indian Penal Code.
The allegation against the petitioner is that being the husband of the victim, he has tortured her for non-fulfillment of demand of Rs. 5,00,000/- cash, motor cycle and LED TV. He has also assaulted the victim with iron rod on her head. Out of wedlock of the couple, the victim has a son, namely, Manbor Hussain aged about 4 years and a daughter, namely, Raunak Jahan aged about 9 years.

Considering the facts and circumstances of the case, the petitioner above named, in the event of his arrest or surrender, within six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Araria/Successor Court in connection with Kursakanta P.S. Case No. 190 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. At the same time, the court below shall take every endeavour of amicable settlement of the issue, after getting the assistance of District Mediation Centre. In case, the mediation process is hampered due to apathy of the petitioner, the court below may cancel the bail bonds of the petitioner.
