JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner, informant and learned APP for the State.

The petitioner is languishing in custody since 04.03.2015 in case registered for the offences punishable under sections 307, 504, 506 and 34 of the Indian Penal Code. It is alleged against the petitioner that he assaulted the informant with 'garasa' on the head.

It is submitted by learned counsel for the petitioner that injury has been found superficial simple in nature caused by this petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is submitted by learned counsel for the informant that the petitioner caused three injuries on scalp of the informant

Patna High Court Cr.Misc. No.19450 of 2015 (3) dt.25-06-2015 2/2 which suggest the intention of the petitioner to kill the informant. Considering the fact that investigation has already concluded and the petitioner has no criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Konch P.S. Case No. 167 of 2014.
