The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code and sections 3 and 4 of the Explosive Substance Act.

Petitioner is alleged to have thrown bomb on the house of the informant.

Learned counsel for the petitioner submits that prior to this case, daughter of the petitioner had lodged Mahila Police Station Case No. 75 of 2021 for the offence punishable under sections 354(3), 506,509 of the IPC and section 12 of Protection of Children from Sexual Offences (POCSO) Act, 2012 against the informant and this case has been filed in retailation. Besides

Patna High Court CR. MISC. No.7148 of 2023(2) dt.17-04-2023 2/2 this, the bomb thrown by the petitioner did not explode, as such, nobody sustained injury.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Samastipur in Bangara Police Station Case No. 67 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
