2. The petitioner is in custody since 21.02.2016 in connection with Khagaria P.S. Case No. 542 of 2015 for the offence alleged under Section 379 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated on mere suspicion as he happens to be a peon in Nagar Parishad, Khagaria. The lock of the almirah from which an amount of Rs. 1,50,000/- was stolen had not been broken, rather the almirah had been opened and the key of such almirah was kept with one Jitendra Kumar. The petitioner being a peon had no access to the almirah. There is a considerable delay in giving information of the alleged offence to the Executive Officer on 14.08.2015 for the alleged occurrence of 08.08.2015. The

4. In the aforesaid facts let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 542 of 2015.
