The petitioner has been dismissed from service after a disciplinary proceeding against him having been concluded. The appeal / memorial which has been preferred by the petitioner before the DGP, Bihar is still pending consideration.

Mr. Awadhesh Kumar Mishra, learned counsel for

Patna High Court CWJC No.1881 of 2019(2) dt.04-02-2019 2/2 the petitioner has submitted that in the meantime, he has been able to lay his hands upon an order whereby the punishment given to the ASI on similar charges along with the petitioner, has been set aside by the appellate authority. The petitioner in such circumstances is directed to file a fresh representation/memorial/appeal before the DGP, Bihar, indicating that the earlier memorial has already been filed on 08.06.2018 along with all necessary facts, and a copy of this order, within a period of three weeks from today. On receipt of such representation/memorial, the DGP, Bihar shall pass a reasoned order within a period of six weeks thereafter.

With the aforesaid observation / direction, this writ petition stands disposed off.
