The petitioners, namely, Manoj Yadav and Indra Kumar Yadav, seek bail in Kishanpur P.S. Case No. 55 of 2014 for the offence under Sections 413, 414/34 of the Indian Penal Code.
The petitioners were apprehended and from their possession, SIMs, mobiles and one motorcycle were recovered. Learned counsel for the petitioners submits that the recovered motorcycle belongs to Sanjay Yadav, who happens to be a relation of the petitioners, and the petitioners are not accused in any other theft cases.
On the other hand, learned A.P.P. submitted that with regard to one SIM said to have been recovered from the
Patna High Court Cr.Misc. No.29949 of 2014 (4) dt.07-01-2015 2/2 possession of the petitioners, a case is said to have been lodged. It appears that the petitioners are in jail since 28.03.2014 for the recovery of one stolen SIM and motorcycle. Considering the facts aforesaid, the petitioners named above are directed to be released on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in Kishanpur P.S. Case No. 55 of 2014, G.R. No. 527 of 2014.
