JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is named in the first information report on the accusation that he took the deceased from his house and, subsequently, the dead body of the deceased was found. It would appear from perusal of the impugned order that the witnesses supported the above stated fact in course of investigation. The investigation against the petitioner has already been completed. Petitioner does not have any criminal antecedent whereas deceased was a dreaded criminal.
Considering the aforesaid facts and circumstances as

No.20295 of 2016 (2) dt.09-05-2016 2/2 well as submissions of the parties and also taking note of this fact that the detention of the petitioner for interrogation purpose is not required, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Dubey, Judicial Magistrate, 1st Class, Gaya in connection with Paraiya P.S. Case No.91 of 2013.
