The petitioner seeks regular bail in connection with Patahi P.S. Case No. 03 of 2018 for the offences punishable under Section 394 of the Indian Penal Code.
The allegation is regarding unknown miscreants having snatched a bag from the informant containing Rs. 5500/-, two blankets and other clothes, after giving iron rod blow on the head of the informant, causing cut injury.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that neither any recovery has been made from the petitioner nor any T.I. parade has been held to connect the petitioner with the alleged crime. Lastly, it is submitted that the
Patna High Court Cr.Misc. No.4928 of 2019(2) dt.29-01-2019 2/2 petitioner is accused in one case, but he is on bail in that case. It is further submitted that the petitioner is languishing in custody since 26.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial Magistrate, at Motihari, East Champaran in connection with Patahi P.S.
